BIMTLY, operated by Prelako d.o.o., a company registered in Zagreb, Croatia (“Prelako”), considers the privacy and online security of our users (“Users”, “you”, “your(s)”) to be of utmost importance. Throughout this Privacy Policy, “BIMTLY”, “we”, “us”, and “our(s)” refer to the BIMTLY services provided by Prelako d.o.o.

This Privacy Policy is intended to help you understand how and what personal information we collect, use, and disclose when you use our Service, which includes the BIMTLY application, platform, website, mobile application(s), APIs, and related services (collectively, the “Service(s)”). We will not use or share your information with anyone except as described in this Privacy Policy.

By using the Services and accepting our Terms of Use and Privacy Policy, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used here have the same meanings as in our Terms of Use.

What Information We Collect

Information You Provide to Us

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your email address, name, phone number, postal address, credit card information, and other information (“Personal Information”). We collect this information to provide the Services, identify and communicate with you, respond to your requests/inquiries, process your purchase orders, and improve our Services.

Information You Provide by Communicating with Us

We may collect Personal Information from you, such as email address, phone number, or mailing address, when you request information about our Services, register for BIMTLY’s newsletter or programs, request customer or technical support, or otherwise communicate with us.

Content You Provide Using Our Products

The Services include the BIMTLY products you use, where we collect and store content that you post, send, receive, and share. This content includes any information about you that you may choose to include. Examples of content we collect and store include 3D models, textures, and related assets you create or upload, as well as project settings and metadata you configure in our database. Content also includes files and links you upload to the Services. If you use an on-premises version of the Services, we do not host, store, transmit, receive, or collect information about you (including your content), except in limited cases where permitted by your administrator.

Payment Information

We collect certain payment and billing information when you register for paid Services. You might also provide payment information, such as payment card details, which we collect via secure payment processing services.

What We Collect Automatically When You Use the Services

We collect information about you when you use our Services, including browsing our websites and taking actions within the Services.

Your Use of the Services

We keep track of certain information about you when you visit and interact with our Services. This information includes the features you use; the links you click on; the type, size, and filenames of attachments or 3D assets you upload; and how you interact with others on the Services. We also collect information about organizations and people you work with and how you collaborate with them.

Device and Connection Information

We collect information that your browser sends whenever you visit our Service (“Log Data”). This Log Data may include your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Service you visit, the time and date of your visit, the time spent on those pages, and other statistics.

Analytics

We may use third-party services such as PostHog to collect, monitor, and analyze this type of information to enhance our Service’s functionality. These third-party service providers have their own privacy policies addressing how they use such information. When you access the Services via a mobile device, we may automatically collect information including the type of mobile device, unique device ID, IP address, mobile operating system, mobile browser type, location information, and other statistics.

Location Information

We may use and store information about your location depending on your device permissions. We use this information to provide features of our Service and to improve and customize it. You can enable or disable location services at any time through your device settings.

Unique Identifiers

We use unique identifiers such as cookies or your pseudonymized customer ID to track individual usage behavior on our Service, such as time spent on pages and pages viewed during a session.

Mobile Device Identifiers

Mobile device identifiers track certain data and activities on your mobile device, enabling collection of Personal Information (e.g., media access controls) and non-personally identifiable information (e.g., usage data).

We and our third-party service providers collect information about you, your device, and your use of the Service through cookies, web beacons, and other tracking tools (“Tracking Tools”). Tracking Tools help us analyze user behavior and improve the Service.

Web Beacons

Web Beacons embedded in emails or communications track responses and interests to deliver relevant content and enhance Behavioral Advertising.

Social Media Widgets

Our Service may include social media features (e.g., Facebook “like” button). These features may collect Personal Information, governed by this Privacy Policy and third-party privacy policies.

Third-Party Sources

We may use third-party services (e.g., social networks) to obtain publicly available information about you, such as job title or contact details, to enrich your personal information.

Online Behavioral Advertising

Other users may provide your information (e.g., email address) when they create your account in their organization via the Service.

BIMTLY Partners

To Provide the Services to You

We use your information to process transactions, authenticate logins, provide customer support, and maintain the Services.

BIMTLY Partners

We share information with partners providing consulting, sales, or technical services, with your consent where applicable.

Third-Party Apps

Installing third-party apps may give them access to your account information. Their privacy practices are not controlled by us.

Links to third-party sites are governed by their privacy policies, not ours.

Social Media Widgets

Compliance with Enforcement Requests and Applicable Laws

Sharing with Affiliated Companies

We share information with affiliated companies owned or operated by Prelako, under this Privacy Policy’s protections.

If BIMTLY is involved in a merger, acquisition, or asset sale, your Personal Information may be transferred. We will provide notice before such transfers.

How We Store Your Data and Secure It

Data Storage and Security

We use data hosting providers in the United States and EU. You may request storage in Australia or Asia. We implement reasonable security measures to protect your data, but no method is 100% secure.

How Long We Keep Your Information

We retain information based on its type, deleting or anonymizing it when no longer needed, unless stored in backups for legal compliance.

Account Information

We retain your information while your account is active or as needed for legal obligations. Inactive accounts (unaccessed for 1 year) may be deleted.

Managed Accounts

Organizational accounts are retained as required by the administrator.

Marketing Information

We retain marketing preferences for a reasonable period after your last interaction with us.

The Choices We Offer

Your Choices

You can request a copy of your information, object to its use, request deletion or restriction, or obtain it in a structured format. Use account settings or contact us at moc.yltmib@troppus. Limitations may apply (e.g., legal obligations).

Access and Update Your Information

Update your profile or content within the Service’s settings.

Deactivate Your Account

Deactivate your account via settings or contact your administrator or moc.yltmib@troppus.

Delete Your Information

Remove content or profile information within the Service, though some data may be retained for legal purposes.

Request That We Stop Using Your Information

Request cessation of processing by contacting us; we may restrict use pending resolution.

Opt Out of Communications

Opt out of promotional emails via unsubscribe links, account settings, or moc.yltmib@troppus. Transactional messages continue.

Web Browser Controls

Manage cookies and Tracking Tools via browser settings. Our Services do not currently respond to “Do Not Track” signals.

How We Transfer Information Internationally

International Transfers of Information We Collect

We store information primarily in the EU, with an option for the United States and Australia. Transfers occur to wherever we or our providers operate, with steps to protect your data.

International Transfers Within BIMTLY Company

We transfer information to Croatia, using EU-approved standard contractual clauses.

International Transfers to Third Parties

Third-party providers in other countries receive data under EU-approved mechanisms (e.g., standard contractual clauses).

Managing Privacy Under Organization

If your Service is managed by an organization, the administrator controls your account and data. Contact them for privacy inquiries.

Links to Other Sites

Third-party links are governed by their privacy policies, not ours.

Enforcement

If you believe BIMTLY has not followed this policy, contact us at moc.yltmib@troppus, identifying it as a Privacy Policy concern.

Children’s Privacy

Only persons 18 or older may use our Service. We do not knowingly collect data from children under 13. Contact us if you believe we have such data.

Changes to This Privacy Policy

Effective March 25, 2025, this Privacy Policy may be updated. Continued use after changes constitutes acceptance.
